Terms of Service for AICaller.io

These Terms of Service ("Terms") constitute a legal agreement between you ("you," "Customer," or "User") and AICaller.io ("Company," "we," "us," or "our") and govern your use of our AI-powered calling software and related services (collectively, the "Service"). By accessing or using AICaller.io, you agree to these Terms.
1. Eligibility and Account Registration
To use the Service, you must be at least 18 years old and legally capable of entering into a binding agreement. You are responsible for providing accurate and complete information when registering for an account and for keeping your login credentials secure.
You agree not to share your account access with others or allow unauthorized individuals to use the Service via your account.
2. Service Overview and Customer Responsibilities
AICaller.io offers a platform that enables automated voice calling via AI voice agents. However, we do not provide telephony accounts or calling services. You are required to:
- Create and manage your own telephony provider accounts (e.g., Twilio)
- Integrate such accounts into the AICaller.io platform
- Ensure all communications (calls, recordings, messages) comply with applicable laws
- Accurately configure call scripts, contact lists, and any message templates
- Maintain up-to-date consent from your call recipients where required
3. Legal Compliance and User Liability
You are solely responsible for complying with all applicable laws, including:
U.S. Federal and State Laws, such as:
- Telephone Consumer Protection Act (TCPA)
- CAN-SPAM Act
- Truth in Caller ID Act
- State-level privacy and consumer protection laws (e.g., CCPA, VCDPA)
EU and UK Regulations, including:
- General Data Protection Regulation (GDPR)
- ePrivacy Directive
Other local laws of:
- Your country of operation
- The countries and jurisdictions you are contacting
Each user acts independently, and AICaller.io does not jointly participate in the content, timing, or targeting of communications.
AICaller.io is not liable for any violations, claims, or fines incurred by your use of the Service. You agree to indemnify us for any liabilities resulting from your actions.
4. Acceptable Use
You may not use the Service to:
- Send spam, phishing messages, or unsolicited calls
- Harass, abuse, or threaten individuals
- Violate intellectual property rights or proprietary information
- Transmit unlawful, obscene, or deceptive content
- Mislead recipients about your identity or intentions
We reserve the right to suspend or terminate your account for any misuse of the platform or breach of applicable law.
5. Subscription Plans and Payment
Certain features of AICaller.io are only available under paid subscription plans. By subscribing, you authorize us or our payment processors to charge your designated payment method. All charges are non-refundable except as required by law.
Plans automatically renew unless cancelled prior to the next billing cycle.
You remain responsible for all usage, even during trial periods.
6. Intellectual Property
All intellectual property related to AICaller.io—including software, branding, documentation, and platform features—remains the exclusive property of the Company. You may not:
- Reverse-engineer or decompile any part of the Service
- Repurpose or sublicense our code or content
- Use our trademarks or materials without express written permission
You retain rights over the data and scripts you upload to the platform.
7. Data Privacy and Processing
Your use of the Service is also governed by our [Privacy Policy] and [Data Processing Agreement], which are incorporated into these Terms. You acknowledge and agree to these documents and confirm that:
- You are the controller of any personal data processed via your telephony setup
- You have secured necessary consent or lawful basis for such processing

The Service is provided “as is” and “as available” without warranty of any kind. We do not guarantee:
- 100% uptime, availability, or accuracy
- Delivery of every call or message
- Compliance with your unique legal obligations
Use of the Service is at your own risk.
9. Limitation of Liability
To the fullest extent permitted by law, AICaller.io shall not be liable for:
- Indirect, incidental, special, or consequential damages
- Loss of data, profits, or business opportunities
- Regulatory fines or penalties resulting from your conduct
Our maximum liability to you will not exceed the amount you paid to us in the twelve (12) months preceding the claim.
10. Indemnification
You agree to defend, indemnify, and hold harmless AICaller.io and its officers, employees, affiliates, and licensors from any claim, liability, or demand—including reasonable legal fees—arising out of:
- Your breach of these Terms
- Your violation of any law or regulation
- Your misuse of the Service
11. Termination and Suspension
We reserve the right to suspend or terminate your access to the Service at our discretion, especially in cases of non-payment, legal violations, or misuse.
You may also terminate your account at any time by contacting support. Termination does not exempt you from outstanding payment obligations.
12. Governing Law and Dispute Resolution

You acknowledge and agree that you operate your communication campaigns independently, and AICaller.io is not a party to, nor does it control, the content, timing, targeting, or recipients of your calls, messages, or campaigns.
AICaller.io does not initiate, author, or approve any specific communication sent via your integrated telephony account. No agency, partnership, joint venture, or employer-employee relationship is intended or created by your use of the Service.
15. Call Recording Compliance
If you choose to enable call recording functionality using your integrated telephony provider, you are solely responsible for complying with all applicable laws related to call monitoring and recording, including but not limited to federal, state, and international two-party consent laws.
AICaller.io does not monitor or enforce compliance with recording disclosures and disclaims all liability for your failure to provide adequate legal notice or obtain proper consent.
16. SMS and Email Campaign Responsibility
If you use AICaller.io or any third-party integration in connection with SMS or email communication, you are solely responsible for ensuring compliance with all applicable messaging laws and guidelines, including but not limited to the CAN-SPAM Act, CTIA rules, and international data privacy laws such as GDPR.
You must maintain accurate recipient consent records and honor opt-out requests in accordance with regulatory standards.
